Sec 66A of IT Act struck down !!

In a landmark judgement upholding freedom of expression, the Supreme Court today struck down a provision in the cyber law which provides power to arrest a person for posting allegedly "offensive" content on websites.
Terming liberty of thought and expression as "cardinal", a bench of justices J Chelameswar and R F Nariman said, "The public"s right to know is directly affected by section 66A of the Information Technology Act."
Justice Nariman, who pronounced the verdict in a packed court room, also said that the provision "clearly affects" the fundamental right to freedom of speech and expression enshrined under the Constitution.
Elaborating the grounds for holding the provision as "unconstitutional", it said terms like "annoying", "inconvenient" and "grossly offensive", used in the provision are vague as it is difficult for the law enforcement agency and the offender to know the ingredients of the offence.
The bench also referred to two judgements of separate UK courts which reached different conclusions as to whether the material in question was offensive or grossly offensive.
"When judicially trained minds can reach on different conclusions" while going through the same content, then how is it possible for law enforcement agency and others to decide as to what is offensive and what is grossly offensive, the bench said, adding, "What may be offensive to a person may not be offensive to the other".
The bench also rejected the assurance given by NDA government during the hearing that certain procedures may be laid down to ensure that the law in question is not abused.

 धारा 66-ए निरस्त

एक महत्वपूर्ण फैसले में सुप्रीम कोर्ट ने आईटी एक्ट की धारा 66-ए को निरस्त कर दिया है, जिसके तहत सोशल मीडिया पर विवादास्पद टिप्पणी या सामग्री पोस्ट करने पर कार्रवाई होती है.
शीर्ष अदालत ने कहा कि सोशल मीडिया पर विवादास्पद टिप्पणी को लेकर आईपीसी की अन्य धाराओं को तहत कार्रवाई हो सकती है, लेकिन 66-ए के तहत अब मामला नहीं चलाया जा सकेगा.
इसके निरस्त किए जाने से अब टिप्पणियों पर तुरंत होने वाली गिरफ्तारियों पर रोक लगेगी. हालांकि, नागरिकों को बिना सोझे-समझे कुछ भी बोलने या पोस्ट करने की आजादी नहीं होगी. सुप्रीम कोर्ट ने सूचना प्रौद्योगिकी अधिनियम के अन्य प्रावधानों धारा 69-ए और धारा 79 को निरस्त नहीं किया और कहा कि वे कुछ पाबंदियों के साथ लागू रह सकती हैं.
क्या कहा अदालत ने..
धारा 66-ए असंवैधानिक है. इससे संविधान के अनुच्छेद 19 (1) में प्रदत्त अभिव्यक्ति की आजादी का हनन होता है. सूचना प्रौद्योगिकी कानून के इस प्रावधान से आम आदमी के जानने के अधिकार का भी उल्लंघन होता है. हम अभिव्यक्ति की आजादी का सर्मथन करते हैं. सोशल मीडिया पर विचारों, संवाद का आदर करते हैं और ईमानदार विरोध, मत, नामंजूरी या आलोचना के संवाद पर लगाम लगाने के पक्ष में नहीं हैं.

मैं उच्चतम न्यायालय के उस फैसले का स्वागत करता हूं जिसमें धारा 66-ए को असंवैधानिक ठहराया गया है. इस धारा को सही तरीके से तैयार नहीं किया गया था और यह कमजोर थी. वास्तव में इसका दुरुपयोग हुआ.

पहली जनहित याचिका 2012 में विधि छात्रा श्रेया सिंघल ने दायर की थी. उन्होंने आईटी अधिनियम की धारा 66-ए में संशोधन की मांग की थी. यह याचिका दो लड.कियों शाहीन ढाडा और रीनू श्रीनिवासन को ठाणे जिले के पालघर में गिरफ्तार करने के बाद दायर की गई थी. उनमें से एक ने शिवसेना नेता बाल ठाकरे के निधन के बाद मुंबई में बंद के खिलाफ टिप्पणी पोस्ट की थी.
