The RTE goal In Maharashtra is to ensure that all children are provided good quality elementary education in well-equipped schools, with trained teachers.  If one looks at the school and enrolment statistics, the enormity of this goal becomes apparent. In 2011-2012, while Pune had over 1,000 schools having primary or upper primary sections, the corresponding figure for 2011-12 in Maharashtra was 1 lakh schools. The number of students enrolled in Classes 1-8 was over 16 million.




Who are the eligible categories of children in Maharashtra?
In the notification on the 25% reservation provision, the Maharashtra Rules define these eligible categories as:
  • Children belonging to disadvantaged group means a child belonging to the Scheduled Caste, Scheduled Tribe and any other category that it specifies to be disadvantaged.
  • Child belonging to Vimukta Jati and nomadic tribes (VJNT), Other Backward Class (OBC), Special Backward Classes (SBC) and religious minorities specified by the State Government and annual income of whose parent or guardian is below one lakh rupees.
  • The Rules also note that preference shall be given to girls.
Free education, according to the Maharashtra Rules, means that children admitted under the 25% reservation provision are provided with free textbooks, writing materials and uniforms. it also notes that they"shall not be discriminated in any manner pertaining to entitlements and facilities such as textbooks, uniforms, library, Information and Communication Technology facilities, extra-curricular activities and sports, etc."
The Maharashtra Rules also note that these children shall:
  • Not be given discriminatory treatment.
  • Not be segregated from the other children in the classroom.
  • Not be taught in classes held at places and timings different from the classes held for other children.
  • Not attend programmes conducted separately for them, except extra classes. These classes are the only exception to holding common programmes for all children in a school.

2. Which schools in Maharashtra are expected to implement the 25% Free Reservation provision?

The Maharashtra Rules note that this provision applies to all schools in the State, except the schools owned or controlled by the State Government, or a Local Authority. It also follows the 2012 Supreme Court decision and excludes unaided minority schools.

3. Which groups of children are eligible in Maharashtra for admission under the 25% Free Reservation provision?
The Maharashtra Rules states that the following are eligible:
  • Child belonging to the Scheduled Caste, Scheduled Tribe and any other category that it specifies to be disadvantaged.
  • Child belonging to Vimukta Jati and nomadic tribes (VJNT), Other Backward Class (OBC), Special Backward Classes (SBC) and religious minorities specified by the State Government and annual income of whose parent or guardian is below one lakh rupees
  • The Rules also note that preference shall be given to girls.

4. Are disabled children also eligible under the 25% Free Reservation provision?

Yes, but since the Maharashtra State has not notified the district or school authorities about this , children with disability in Maharashtra may at present not be considered for admission under this provision. The 2012 RTE Act amendment has also included children with varying disabilities under the definition of disadvantage. Therefore, these children are legally entitled to be included with other children from socio-economically disadvantaged groups for admission under the 25% Free reservation provision.

5. What is the residence distance from school required to be eligible for admission under the 25% Free Admission provision?
Children have to live within 1 km.

6. What is a school expected to provide by way of free education?

Free education, according to the Maharashtra Rules, means that children are provided with free textbooks, writing materials and uniforms. It also notes that those admitted under the 25% reservation provision "shall not be discriminated in any manner pertaining to entitlements and facilities such as textbooks, uniforms, library, Information and Communication Technology facilities, extra-curricular activities and sports, etc."

7. What are the documents that are required by parents for admission under the 25% Free Admissions Reservation provision?
  • The application for free seats should be made in Form-2.

  • Parents may download the form and submit to the school concerned. 
  • Every application for the admission of child belonging to weaker section shall be accompanied by an income certificate of parent, issued by the Revenue Officer not below the rank of Tehsildar. 
  • Every application for the admission of child belonging to SC, ST, VJNT, OBC, and SBC shall be accompanied by a caste certificate issued by a revenue officer not below the rank of Deputy Collector or any other competent authority, in the name of child or his parent or guardian. 
  • Every such application shall be accompanied by a proof of residence of the child or parent or guardian, such as, Aadhar Card or Passport or Election Photo Identity Card or Electricity bill or Telephone bill or Water bill or a House Tax receipt.

8. Some schools are charging for admission forms and school prospectuses from parents seeking admission under the 25% Free Admission Reservation provision. Is that allowed?

This is illegal. The Maharashtra State 25% Rules and the RTE Act note that no payments can be taken from parents by way of donations, capitation fees, or any other charges including admission forms, registration documents,etc.

9. My daughter is seeking admission under the 25% Free Admissions Reservation provision in a private school? Should she prepare for a test or interview? As parents, will they interview my wife and me?

Children cannot be tested in any way for admission or interviewed. Nor can their parents be interviewed, according to the RTE Act. In case, admission demand is greater than the seats available, the school has to select on a public lottery basis, according to the procedures laid down in the Maharashtra 25% State Rules

10. In case it is required, who should parents complain to?

If the school authorities cannot resolve the issue, parents can lodge a formal complaint with the Education Officer.
